By accessing or using the Vakt Systems platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the Service.
Vakt Systems Ltd. ("Vakt," "we," "us," or "our") provides a cloud-based environmental monitoring platform. The Service includes sensor data ingestion, real-time dashboards, configurable alert thresholds, and reporting for environmental conditions such as temperature, humidity, and water detection.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at [email protected] if you become aware of any unauthorized use of your account. You are responsible for ensuring that account access within your organization is limited to authorized personnel.
You agree to use the Service only for its intended purpose of environmental monitoring. You may not: attempt to gain unauthorized access to the Service or its infrastructure; reverse engineer, decompile, or disassemble any part of the Service; use the Service to store or transmit malicious code; or resell, sublicense, or redistribute access to the Service without written consent from Vakt.
You retain ownership of all data you submit to or generate through the Service, including sensor readings and configuration settings ("Customer Data"). By using the Service, you grant Vakt a limited license to process, store, and transmit your Customer Data solely for the purpose of delivering and improving the Service. We will not use your Customer Data for any other purpose without your consent.
We use reasonable efforts to maintain the availability of the Service, but we do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance from time to time and will provide reasonable advance notice when possible. We are not liable for any damages resulting from service interruptions, delays, or outages.
The Service, including its design, features, code, documentation, and branding, is owned by Vakt Systems Ltd. and is protected by applicable intellectual property laws. These Terms do not grant you any rights to Vakt's intellectual property except the limited right to use the Service as described herein.
The Vakt platform is an environmental monitoring tool and is not a substitute for professional inspections, manual monitoring, or emergency response systems. To the maximum extent permitted by law, Vakt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the fees you paid to Vakt in the twelve months preceding the claim.
Either party may terminate the Service agreement with 30 days' written notice. Upon termination, you will have a 30-day window to export your Customer Data. After this period, we may delete your data in accordance with our data retention practices. We may also suspend or terminate your access immediately if you materially breach these Terms.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
